Once a guest pays, the amount (minus fees) legally belongs to the host; Airbnb merely holds it "in trust" until settlement 24 hours after check-in — so an automatic refund would be giving away someone else's money. In early 2020, Airbnb unilaterally issued blanket full refunds to guests, overriding host-set cancellation policies. Hosts who lost bookings overnight filed a class action (Farmer v. Airbnb, 2020) in the US Northern District of California, alleging breach of contract and fiduciary duty. Airbnb subsequently narrowed unilateral refunds to a clearly defined "Extenuating Circumstances Policy," and redesigned every other refund to require the host's own cancellation policy or explicit consent. Today's "host consent required" rule is a direct result of that lawsuit.
